AfterShip Acceptable Use Policy

This Acceptable Use Policy (the “AUP”) describes rules that apply to any party (“You”, “Your”, or “User”) using any Service provided by Automizely Pte. Ltd. (“We”, “Us”, “Our”, or “AfterShip”). This AUP is subject to and forms part of the AfterShip Terms of Service. The examples described in this AUP are not exhaustive, and User is responsible for its compliance with this AUP. If User violates this AUP, AfterShip may, at its sole discretion, suspend or terminate User’s use of the Service. In the event of suspension or termination based on the violation of this AUP, User shall not be entitled to any refund or credit whatsoever. Capitalized terms used below but not defined in this AUP have the meanings set forth in Our Terms of Service.
SECTION 1: PROHIBITED AND RESTRICTED PRODUCTS AND SERVICES
1. PROHIBITED PRODUCTS AND SERVICES
You are prohibited from using AfterShip’s Services for any of the following activities:
1.1.Illegal Products and Services:
- Sale, promotion, or purchase of illegal narcotics, drugs, chemical substances, imitations of such substances, or equipment designed for their manufacture.
- Services related to fraudulent references or false identification.
- Manipulation or misuse of telecommunications equipment (e.g., jamming devices).
- Actions that tamper with or violate the security, integrity, or availability of any network, computer or communications system, software application, or computing device.
- Technical abuse, including but not limited to phishing, distributing viruses, worms, Trojan horses, corrupted files, hoaxes, or other destructive or deceptive activities.
- Products or services promoting self-harm.
- Products or services that exploit or abuse children, including depictions of child abuse or sexual exploitation, or any material presenting children in a sexualized manner.
- Products or services that support, promote, or fund terrorist organisations or related activities.
Any business or organisation that:
Engages in, promotes, or celebrates unlawful violence or physical harm toward individuals, animals, or property; or
Encourages violence against groups based on race, religion, disability, gender, sexual orientation, national origin, or any other immutable characteristic.
Any other products or services in violation of applicable laws, regulations, government orders, or industry standards.
1.2 Infringement of Third Party Intellectual Property Rights:
Sale or distribution of copyrighted materials (e.g., music, movies, software) without proper authorization.
Counterfeit goods.
Illegally imported or exported products.
Unauthorized sale of brand name or designer products.
Any activities that infringe or facilitate the infringement of trademarks, patents, copyrights, trade secrets, or proprietary or privacy rights of third parties.
1.3 Unfair, Predatory, or Deceptive Practices:
Pyramid schemes.
“Get rich quick” schemes, including:
Investment opportunities or services promising high rewards with minimal effort.
Sites offering fast or easy money, using deceptive testimonials, or making unrealistic claims.
Businesses offering unrealistic incentives but failing to deliver on commitments.
Negative response marketing and telemarketing.
Predatory practices in mortgage consulting, lending, credit repair, or investment opportunities.
Remote technical support, essay mills, chain letters, or pay-to-remove mugshot publications.
Unsolicited or illegal mass emails, promotions, or advertising.
Activities falsely implying sponsorship or affiliation with AfterShip or its subcontractors.
Conceal or misstate information about Your business, product, or service (e.g., using a false identity, business name or contact information, offers for products or services that are normally offered for free or misrepresenting an affiliation with a political organization).
Contain information which is not clearly relevant to the actual product or service.
Fail to disclose the payment model and full expense that a user will bear (e.g., shipping costs and other billing related information; recurring subscription costs).
Harvesting or collecting information, including email addresses, without consent.
Any other activities considered deceptive, unfair, or predatory toward consumers.
1.4 Misuse of AfterShip Products and Services
Using AfterShip’s Services with false identities or providing misleading information.
Using AfterShip’s intellectual property (e.g., name, logo, trademarks) without prior written consent, or in a manner inconsistent with AfterShip’s Terms of Service.
2. RESTRICTED PRODUCTS AND SERVICES
You are prohibited from using AfterShip’s Services for the following activities unless both of the following conditions are met:
The activities comply with applicable laws and regulations in Your and Your End-Users’ jurisdictions.
You have received prior written approval from AfterShip (an “Approval”). For the avoidance of doubt, payment of fees or conclusion of a binding agreement for the provision of Services shall not constitute an Approval and only an express waiver making reference to this AUP and the portions therein to the extent waived shall constitute an Approval.
2.1. Pornography
- Includes any pornographic or sexually explicit materials or services.
2.2. Cannabis Products
- Cannabis, cannabis dispensaries, products containing CBD/THC, or related businesses.
2.3. Government Services
- Includes government grants, embassy or consulate services, or services tied to foreign governments.
2.4. Pharmaceuticals and Telemedicine
- Online pharmacies, prescription-only products, and telemedicine/telehealth services.
2.5. Alcohol and Tobacco Products
2.6. Firearms, Explosives, and Other Dangerous or Hazardous Materials
2.7. Gambling Services
- Gambling, fantasy sports, lotteries, bidding fee auctions, or other games of chance with monetary or material prizes.
2.8. Cryptocurrency Services
SECTION 2: SPECIFIC POLICIES
1. AUTHORIZED SUBPROCESSORS
Some AfterShip Services are managed by the Authorized Subprocessors as described here. Users must comply with all terms, conditions, and restrictions of the Authorized Subprocessors.
2. USE OF AFTERSHIP IN CONNECTION WITH SHIPPING ACTIVITIES
Users must not use AfterShip’s Services for shipping activities that breach any Authorized Carrier’s terms, conditions, or policies. Compliance with all applicable restrictions is the User’s responsibility, including those restrictions set forth by the Authorized Carriers, a list of which is available here.
3. USE OF AFTERSHIP IN CONNECTION WITH THIRD-PARTY PLATFORMS
Users must not engage in restricted or prohibited activities under third-party platform terms (e.g., Shopify, WooCommerce). Compliance with these terms is the User’s responsibility.
4. AGE GATING
For activities involving alcohol, firearms, gambling, tobacco, cannabis, or adult content, Users must ensure that End-Users meet the legal age of consent in their location. Proof of age gating implementation must be available upon request.
5. USE OF AFTERSHIP IN CONNECTION WITH NOTIFICATIONS/MESSAGES (SMS/WHATSAPP/EMAILS)
You shall not use AfterShip’s Service for notifications/messages (including SMS/WhatsApp/Emails) in connection with the following activities:
Any notification/message in violation of Twilio Terms of Service, Twilio Messaging Policy, Twilio Acceptable Use Policy, Twilio Country-Specific Guidelines and Twilio Country Specific Requirements;
Any notification/message in violation of any other applicable terms and conditions issued by Twilio;
Sending unsolicited messages;
Sending illegal messages or messages containing illegal or infringing content;
Sending messages that result in an unacceptable number of spam or unsolicited email complaints; and
Misrepresenting Your identity (e.g., spoofing).
SECTION 3: ENFORCEMENT
You warrant and represent that Your use of the Service will comply with this AUP.
AfterShip reserves the right, but not the obligation, to monitor or investigate Your use of the Service at any time to ensure compliance with this AUP, the Terms of Service, and any other applicable agreements between You and AfterShip. AfterShip retains sole discretion in determining whether a violation of this AUP has occurred, and any and all determinations will be final and binding.
In the event that AfterShip, acting in good faith, determines that You have breached this AUP, or if Your activities are found to violate the letter or spirit of this AUP (including conduct outside your use of the Service), AfterShip may take enforcement actions, including:
Suspending or terminating Your account, or
Restricting Your access to the Service.
Such actions may be taken at AfterShip’s sole discretion and without prior notice or liability.
