AfterShip Reviews is a Service provided by AfterShip under its Terms of Service, which enables Users to collect and display online reviews (“AfterShip Reviews”) on their eCommerce websites (each, a “Store”). This Content Policy (this “Policy”) governs the use of AfterShip Reviews and supplements the Terms of Service and applicable Feature-Specific Terms. Capitalized terms not defined in this Policy have the meanings assigned in the Terms of Service.

1. AFTERSHIP REVIEWS SERVICE

AfterShip Reviews allows End-Users to submit reviews on a User’s Store, including information, text, photos, and/or videos (“Content”). This Content is made available directly on the Store. The User is solely responsible for all Content submitted by End-Users, including without limitation its legality, reliability, accuracy, appropriateness, and compliance with this Policy and applicable laws. AfterShip disclaims any responsibility or liability for any loss, cost, or damage related to such Content.

AfterShip Reviews is provided on an “as-is” and “as-available” basis and may not be accessible in all regions, at all times, or under all conditions. AfterShip disclaims all liability for delays, disruptions, or failures in the submission, display, or removal of Content, including issues arising from third-party integrations or internet connectivity.

2. PROHIBITED CONTENT

By using AfterShip Reviews, the User represents and warrants that all Content submitted or displayed on the Store complies with the following requirements:

  1. Unlawful, Offensive, or Misleading Content: Content must not be false, unlawful, misleading, libellous, defamatory, obscene, pornographic, profane, indecent, lewd, suggestive, harassing (or advocate harassment of another person), threatening, offensive, invasive of privacy or publicity rights, abusive, inflammatory, inaccurate, inappropriate, fraudulent, or otherwise objectionable in AfterShip’s reasonable discretion.
  2. Spam or Junk Messaging: Content must not constitute mass mailings, spamming, junk mail, chain letters, pyramid schemes, or similar disruptive communications.
  3. Irrelevant or Off-Topic Messaging: Content must directly relate to the reviewed product or service and may not include unrelated commentary, including political or social controversies or personal attacks.
  4. Restricted or Regulated Commercial Content: Content must not promote or offer products or services subject to regulatory restrictions, including but not limited to alcohol, gambling, tobacco, firearms, health or medical devices, regulated pharmaceuticals, or adult services.
  5. Personal Data Use: Except for the username of the End-User, Content must not contain personal data such as full names, addresses, phone numbers, email addresses, government-issued identification numbers, or financial information.
  6. Illegal or Infringing Material: Content must not depict or promote unlawful activity, including infringement of intellectual property or privacy rights, depictions of rape, human trafficking, or other dangerous or illegal acts, sales or promotion of illegal goods, or graphic violence or content promoting violence.
  7. Terrorism and Extremism: Content must not promote, support, incite, or glorify terrorism or related activities.
  8. Sexually Explicit Content or Exploitation of Minors: Content must not include sexually explicit material or depict minors in any sexual context.
  9. Discriminatory, Hateful, or Harmful Content: Content must not threaten or promote harm to individuals or groups, or incite hatred, discrimination, or disparagement on the basis of race, ethnicity, religion, disability, age, nationality, veteran status, sexual orientation, gender, gender identity, or any other protected status.
  10. Impersonation and Deceptive Conduct: Content must not impersonate any person or entity or misrepresent the source or affiliation of the poster.
  11. Conflict of Interest: Content must not be submitted by individuals with a vested interest in the product or service unless such interest is clearly disclosed.
  12. Malicious Code and Security Risks: Content must not include viruses, malware, corrupted data, or other harmful or disruptive code.
  13. External Links and Domains: Content must not contain URLs, domain names, or hyperlinks to external sites.

3. MONITORING AND REMOVAL OF CONTENT

AfterShip is not obligated to review or moderate Content posted via the Store, but may do so at its discretion for operational, legal, or compliance purposes. AfterShip reserves the right to remove, edit, or block any Content at any time and without notice if it (i) violates this Policy or applicable law, (ii) is reasonably necessary to protect the rights of AfterShip or third parties, or (iii) is otherwise deemed inappropriate by AfterShip.

4. ENFORCEMENT

The User acknowledges that AfterShip Reviews is provided by AfterShip to the User, and AfterShip does not maintain a direct relationship with any End-User. The User must ensure that End-Users are bound by terms at least as restrictive as this Policy and are not permitted to submit unlawful or infringing Content. The User is solely responsible for the actions of its End-Users.

5. INDEMNITY

In addition to the indemnification obligations in the Terms of Service, the User agrees to indemnify, defend, and hold harmless AfterShip and its affiliates, officers, directors, employees, and agents from and against any and all claims, demands, actions, damages, penalties, fines, losses, liabilities, and expenses (including reasonable attorneys’ fees and court costs) arising out of or relating to (a) the User’s or any End-User’s use of AfterShip Reviews, or (b) any Content submitted or displayed through the Store.
