AfterShip will manage Your Personal Data collected through the websites located at www.aftership.com, the mobile applications, the API related services, and the affiliated websites owned by AfterShip Group (collectively "Website") based on AfterShip belief of respect for the individual and in accordance with this AfterShip privacy policy (the “Privacy Policy”).

If You are using AfterShip in a professional capacity, such as a merchant in a business-to-business (B2B) context (“User Representative”), this Privacy Policy governs AfterShip’s role as a Data Controller for Your Personal Data related to customer relationship management and associated activities. For processing activities where AfterShip acts as a Data Processor in providing Services (e.g., fulfilling contractual obligations under an agreement), the terms of the Data Processing Agreement (DPA) between You and AfterShip shall apply.

We collect Personal Data to provide the Services, to improve User interactions with AfterShip, and to communicate with You about shipping information, services, promotions and contests. We try to limit the collected information to support the intended purpose of collection. If You cannot be identified by the data We collect, for example when Personal Data has been anonymized, then this data is not considered Personal Data by this Privacy Policy.

We collect Personal Data when You:

  • Make an online purchase from AfterShip;
  • Request customer service or contact us;

When You ask Us to provide services for the benefit of a third party, You shall be legally authorized by a said third party to disclose his/her Personal Data to AfterShip. This authorization shall cover Personal Data including but not limited to the name, address, phone number, email address, credit card, and shipping information of the third party.

1.2 Purposes of Processing

AfterShip processes Personal Data for the following purposes and legal basis:

For the performance of AfterShip Services. This element covers all technical and commercial processes required to carry-out User requests. Processing is necessary to perform a contract with the User, or in order to conclude one.
To improve the Site, personalize User experience, and enhance User interactions with the Site. Processing is based on AfterShip's legitimate interest to conduct its business, improve its product and service offerings, and facilitate communication.
Promotional communications. Processing is based on Your consent.

For linking various user accounts (i.e., the AfterShip account with other social media or email accounts) and extracting information for specialized requested services. Processing is necessary to perform a contract with the User, or in order to conclude one.

We use Your interactions with AI Features to develop, train, fine-tune, and improve these models to better respond to Your requests, and update classifiers and filters including for safety, language understanding, and factuality. Processing is necessary for Our legitimate interests, including to develop new products and features that are useful for Our users, and provide, maintain, and improve Services to meet the needs of Our users

To accomplish these purposes, We may combine personal and usage information that We collect.

The Personal Data requested with regard to the creation and use of a user account is necessary for the performance of AfterShip Services and to fulfill Your requests. Further Personal Data You provide through linking different accounts, is done so on a voluntary basis or to meet a request that You have made.

The Personal Data will be stored for as long as You have an active account and continue to use AfterShip Services, and for a reasonable period -thereafter for legal or regulatory purposes, including any applicable statute of limitations.

AfterShip will usually remove Your Personal Data generated and/or provided by You once it is no longer necessary for the purposes it was collected, within a reasonable period after it has been generated or provided.

Additionally, Personal Data You provide in connection with the AfterShip Services is anonymized and used by AfterShip for data analysis, for example, to evaluate the performance of shipping carriers.

AfterShip uses Your Personal Data and usage information to offer and provide Our products and services and to support Our core business functions. These include order or service fulfillment, customer service, internal business processes, marketing, including contests and sweepstakes, authentication, loss and fraud prevention, public safety and legal functions.   • To fulfill Your requests for products and services and communicate with You about said requests;

AfterShip use of information received from Google Restricted scopes APIs will adhere to Google’s Limited Use requirements.

3.4 Artificial Intelligence

AfterShip utilizes artificial intelligence (AI) technologies and machine learning to develop, enhance and provide Our Services, including security monitoring, predictive analytics, to perform automated tasks, analysing data, or feature improvements (“AI Features”). Our AI Features are developed and deployed following established ethical guidelines to improve user experience, efficiency, and accuracy. Specific AI Features will be disclosed in relevant service-specific terms and Documentation.

These AI Features process Personal Data in accordance with this Privacy Policy and Applicable Data Protection Laws. By using Our Services, You agree that We may process Your Personal Data for AI Features as described in this Privacy Policy and in the service specific Documentation. AFTERSHIP DOES NOT SELL OR RENT YOUR PERSONAL DATA TO ANY THIRD PARTIES WHATSOEVER.

AfterShip accounts require a username and password to log in. You must keep Your username and password secure, and never disclose it to a third party. Because the information in Your distribution lists is so sensitive, account passwords are encrypted, which means We cannot see Your passwords. We cannot resend forgotten passwords either. We can only reset them.

Your account information is protected by the password You use to access Your online account. Please keep this password confidential.

  1. Privacy of Children Online

We are committed to protecting the online privacy of children. In order to do so, AfterShip does not knowingly collect Personal Data from anybody under the age of 18 without prior parental consent. If We become aware that We have inadvertently received Personal Data from somebody under the age of 18, We will delete such information from Our records.

  1. LIMITATION OF LIABILITY

EXCEPT WHERE PROHIBITED BY LAW, UNDER NO CIRCUMSTANCES SHALL AFTERSHIP BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES (EVEN IF AFTERSHIP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM ANY ASPECT OF AFTERSHIP USE OF THE PERSONAL DATA OF ANY THIRD PARTY PROVIDED BY YOU AND/OR YOUR COMPANY.
